DESMA Center as a member of the Working Group for Legal Analysis and Evaluation related to DKI Jakarta Provincial Regulation Number 6 of 2015 concerning Tourism was also present at the regular meeting of discussions on September 12, 2022. This meeting was held at  the regional office of the Ministry of Law and Human Rights DKI Jakarta. The meeting was opened by the Head of Legal Affairs (Alfik Abdullah) whi was accompanied by the Head of the Sub Division of the Facilitations Formation of Regional Legal Products (Erinawita) and was attended by other members of the Working Group, namely brin principal researchers, legal bureaus, tourism offices and creatuve economy DKI Jakarta province, DESMA Center, JFT, and JFU.

This meeting presented Dr. Moch. Ryan Bakry, SH., MH, yarsi university academic, as a resource person. In his presentation, he explained that the substance of sustainable tourism is not only limited to the focus on tourists who travel but also on local residents and the environment. The resource person also explained the content analysis based on 6 (six) dimensions of Legal Analysis and Evaluation of the articles in the Tourism Regional Regulation. Furthermore, the speakers highlighted the lack of local content in the Tourism Regional Regulation so that the authority of regional autonomy has not been seen as the existing Perda has not emphasized the peculiarities /image / branding of tourism in DKI Jakarta.

DESMA Center provides input to list sustainability principles explicitly on the principles contained in the Perda and consider the potential for wellness tourism in Jakarta as part of local content.

This meeting is expected to help the Working Group to capture important issues related to the implementation of the concept of sustainable tourism linked to existing laws.

Legal analysis and evaluation is part of the concept of testing laws and regulations (executive review) which has not been very well known in constitutional practice compared to the concept of judicial review, or legislative review. Legal analysis and evaluation is aimed at assessing the extent of: legal norms correspond to the idiosyncratic values of the State, whether the goals mandated by the Law have been achieved, the effectiveness of the law, and the gap between expectations and reality.

The results of legal analysis and evaluation activities related to DKI Jakarta Provincial Regulation Number 6 of 2015 concerning Tourism are in the form of recommendations on the status of existing laws and regulations, whether they need to: (1) improvement (revision); (2) reimbursement (repeal); or (3) maintained in order to effectively implement this Bylaw.
